Important Updates for UAB In Vitro Fertilization (IVF) Patients

The UAB Division of Reproductive Endocrinology and Infertility team is working to connect with patients who may be affected by the Alabama Supreme Court’s ruling that a cryopreserved embryo is a human being.

Please visit www.uabmedicine.org/ivfupdates for important updates about the Alabama Supreme Court’s ruling that has caused UAB to pause in vitro fertilization (IVF) treatments that involve egg fertilization, embryo development or embryo transfer as we evaluate the consequences of the Court’s decision.

We continue to be deeply saddened that this ruling has impacted our patients’ attempt to have a baby through IVF, but we must evaluate the potential that our patients and team members could be prosecuted criminally or face punitive damages for merely following the standard of care for IVF treatments. 

Media has reported that Alabama Senate Healthcare Committee Chairman Sen. Tim Melson plans to introduce a bill in the state legislature soon that — if passed — could allow us to reinstate IVF treatments. We will follow this development closely and hope to have positive updates in the near future.

While the pause in IVF treatment is in effect, however, we will continue to work to connect with affected patients directly, as well as follow developments closely and provide updates on this webpage.

  • At this time, we have paused only the process of fertilization and embryo development through IVF. We continue to offer other aspects of infertility care such as intrauterine insemination and egg retrieval for preservation.
  • We understand some patients wish to transport their embryos to another facility. Companies that transport embryos are also assessing the risks associated with the Alabama Supreme Court ruling, and we are working to identify a company that is able and willing as soon as possible. It is our goal to help patients who are interested in this option do so safely, but — at this time — there are no options available.
  • We want to assure you that embryos currently stored at UAB are safe here.
  • Each patient who is under our care has a specific medication and appointment regimen. Please contact your physician/care team for guidance on the management of your regimen and next steps for you in your IVF journey.

Our commitment to our patients has not wavered; but we must comply with the law, and want to ensure that you and our team members are protected from any type of prosecution.
